STANDARD CONTEST RULES APPLICABLE TO ALL CONTESTS

A complete copy of these Standard Contest Rules can be obtained at the offices of radio station KYIS (the “Station”)owned and operated by Cumulus Media Inc. or one of its subsidiary companies, 4045 NW 64th St. #600 Oklahoma City, OK, during normal business hours Monday through Friday or by sending a self-addressed, stamped envelope to the above address.

The Station will conduct all Contests, including on-air contests, email and online contests held on www.989kissfm.com, and contests conducted through the Station’s social networking accounts (e.g., Facebook, Twitter), substantially as described in these rules, and by participating each participant agrees as follows:

 

1.      No purchase is necessary.  Void where prohibited.  All federal, state, and local regulations apply.

2.   Unless otherwise specified, only legal U.S. residents who are 18 years of age or older with a valid Social Security number at the time of entry are eligible to participate in Station contests.  Individuals age 13 to 17 may be eligible to participate in Station contests with the approval of a parent or legal guardian, provided that the parent or legal guardian is a legal U.S. resident at least 18 years of age with a valid Social Security number at the time of entry in the contest.

3.      Unless otherwise specified, employees, agents and affiliates of Cumulus Media Inc. and its subsidiaries, contest sponsors, other radio, television and print advertising companies serving the Station’s metro area, and their immediate family members and household members are not eligible to participate or win Station contests.  The term “immediate family members” includes spouses, parents, siblings, grandparents, children, grandchildren and cohabiting significant others.

4.      An individual may win a Station contest only once per six-month period unless otherwise specifically stated.   An individual may win other seasonal or one-time contests only once for the duration of the contest.  The Station reserves the right to limit the number of times an individual may enter a contest or drawing.  The Station reserves the right to require contestants to be present at drawings in order to win their prize.

5.      Potential contest winners will be selected by and at the Station in its sole discretion.  If it is determined by the Station that a candidate is not eligible to receive a prize, another candidate may be selected for eligibility consultation and this process will continue on until such time as an eligible candidate is found.  In the unlikely event that no candidates are found to meet the specifications, then the prize will go un-awarded.  In the event of a tie, the winner will be determined by and at the sole discretion of the Station.

6.      Time Delay Between Over-the-Air Analog Signal and Other Signal Delivery: Due to the time delay that exists between the Station’s analog over-the-air signal and the Station’s online webcast, listeners who listen to the Station online may hear Contest information or a cue to call later than listeners listening to the Station’s analog over-the-air signal. As a result, the odds of an online listener winning this Contest may be diminished.

7.      Unless otherwise stated, the odds of winning a Station contest depend on a number of factors, including but not limited to the number of eligible entries received and the number of listeners participating at any given time.

8.      All State, Local, Federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner.  All those who win a prize or prizes valued $600 or more in a given calendar year will be issued an IRS Form 1099 to report their winnings.

9.      All prizes are awarded “as is.”   Prizes are nontransferable and cannot be exchanged, sold, or redeemed for cash or other prizes. No substitute prize will be awarded to a winner who declines to accept a prize. The Station shall not be responsible for a failure of participating sponsors to deliver the prizes or any part thereof.

10.  All entrants and winners agree that the Station shall have no liability for any injury, misfortune, or damage to either persons or property incurred by entering, participating in, winning, or losing any contest and/or by the use or non-use of any prize received in connection with this contest.

11.  All prizes must be claimed in person at the Station at the address identified above during regular business hours and within ten (10) business days of winning, excluding holidays.  After such time, ownership of said prize reverts back to the Station to be disposed of at its discretion.  The winner then loses all claims and rights to said prize.  Proper identification must be presented by any winner to claim prize.  As a condition to receiving the prize, any potential winner must complete and sign a Winner’s Affidavit and Release, releasing the Station from all liability in connection with winner’s participation in the contest and acceptance, use, or non-use of the prize.

12.  All entry blanks, forms, devices, and materials gathered during the course of entry, as well as all information contained on or within, shall become the sole property of the Station to be used, disposed of or destroyed in its sole discretion.  The Station is not responsible for any incorrect or inaccurate information submitted by contest participants or entered by websites users, and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the Station’s website.

13.  All entrants and winners agree to give the Station and its licensees, affiliates, successors, and assigns the irrevocable and unrestricted right to use, re-use, broadcast, or publish their name, city of residence, photo, video tape, film or any other likeness, including portraits and pictures, in whole or in part, as part of a composite, retouched or distorted in character or form, and voice, recorded or live, for any reason the Station deems necessary without compensation, unless prohibited by law.  All entrants and winners release, discharge, and agree to hold the Station harmless from any and all claims they may have against the Station in connection with the foregoing.  All entrants and winners further acknowledge that the Station and owns or will own exclusively any photographs of them used for such purposes, including the copyrights in them, regardless of the form in which they have been or may be produced and used, and all entrants and winners assign all such ownership rights to the Station.

14.  By participating in a Station contest, each participant agrees to receive email communications from the Station regarding Station events and contests. Any participant that opts-out of these mailings will also remove themselves from the contest.  By participating in the contest, where allowed by law, participants agree that the Station may disclose personal information obtained from participants in the contest to third parties and use such information for marketing and other purposes.

15.  By participating in a Station contest, participants agree to be bound by the decisions of Station personnel. Participants who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Station will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the contest and all Station decisions concerning such disputes shall be final. If the conduct or outcome of a contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Station, the Station reserves the right to terminate the contest, or make such other decisions regarding the administration or outcome as the Station deems appropriate. All decisions will be made by the Station are final. The Station may waive any of these rules in its sole discretion. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF A STATION CONTEST, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF A STATION CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, STATION RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.

16.  By participating in this contest, each participant agrees to waive any and all claims for damages for death, personal injury, loss of property or property damage that he or she may sustain as a result of his or her participation in the contest and/or the use of any prize, and any damages or losses arising from the implementation or carrying out of the contest or any participant’s failure to win the contest or receive the prize, and to release Cumulus Media Inc., the Stations, and their parent companies, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability arising out of or connected in any way with his or her participation in the contest, even though that liability may arise out of an intentional act, omission, negligence or carelessness  on the part of the persons or entities mentioned above.

17.  A winners list may be obtained five (5) days after the conclusion of any Station contest by sending a self-addressed stamped envelope to the Station at the address first written above.

WWLS/KQOB’s “Fort Thunder Harley Davidson Roadster” Contest
Official Rules

A complete copy of these rules can be obtained at the offices of radio station WWLS/KQOB (“Station”), owned and operated by Cumulus Media Holdings Inc. or one of its subsidiary companies, 4045 NW 64th Suite 600, Oklahoma City, OK 73116, during normal business hours Monday through Friday or by sending a self-addressed, stamped envelope to the above address.

The Station will conduct the WWLS/KQOB “Fort Thunder Harley Davidson Roadster XL1200CX” Contest (the “Contest”) substantially as described in these rules, and by participating, each participant agrees as follows:

 

  1. No purchase is necessary. Void where prohibited.  All federal, state, and local regulations apply.

Eligibility.  This Contest is open only to legal U.S. residents age eighteen (18) years or older at the time of entry with a valid Social Security number and who reside in the Station’s Designated Market Area (“DMA”) as defined by Nielsen Audio, who have not won a prize from the station in the last 90 days or a prize valued at $500 or more in the last 180 days, and whose immediate family members or household members have not won a prize from the station in the last 90 days or a prize valued at $500 or more in the last 180 days.   Void where prohibited by law.  Employees of Cumulus Media Holdings Inc., its parent company, affiliates, related entities and subsidiaries, promotional sponsors, prize providers, advertising agencies, other radio stations serving the Station’s DMA, and the immediate family members and household members of all such employees are not eligible to participate. The term “immediate family members” includes spouses, parents and step-parents, siblings and step-siblings, and children and stepchildren.  The term “household members” refers to people who share the same residence at least three (3) months out of the year. The Contest is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.  There may only be one (1) Qualifier per immediate family or household member.  If more than one (1) immediate family member or household member presents at the Grand Prize event ONLY the Qualifier who first qualified will be eligible to participate in the Grand Prize event.

  1. Contest Period. The Contest will begin at 12:01a.m., CT on April 24, 2017 and will run through 08:59 p.m. CT on June 29, 2017 (the “Contest Period”).  The Station’s computer is the official time keeping device for this Contest.
  2. How to Enter. You will automatically be entered into the Contest once you complete one of the following:

(i)  Remote BroadcastAttend a remote broadcast conducted by KQOB/WWLS and complete an entry form.  Limit one (1) entry per person per remote broadcast.  All entries must be received by the deadline stated at the remote broadcast. When each of the remote broadcast concludes, five (5) entries will be pulled from all entry forms and those entries will win a “key” which qualifies that person for the final drawing. The remote broadcast registration and drawing will be at Fort Thunder Harley Davidson , 500 SW 11th Street Moore, OK 73160, May 25, 2017 from 5:00 p.m. – 7:00 p.m., June 8, 2017 from 5:00 p.m. – 7:00 p.m. and on June 29, 2017 from 5:00 p.m. – 6:30 p.m. A total of ten (10) individuals will qualify to win the Grand Prize via this method. .

(ii) Text:  Text in words which will be announced over the air weekdays at approximately 9:00 a.m., 2:00 p.m. and 5:00 p.m. Send a text message with the designated keyword for that specific date and time to 68683 during the Sweepstakes Period.  All entries must be received by 11:59 pm CT on June 16, 2017 to be eligible for the grand prize drawing.  Standard text messaging rates, as established by an individual’s wireless carrier, may apply, and Station assumes no responsibility for any fees or charges incurred for and associated with any text message sent to or from Station.  Any and all fees arising out of the transmission of a text message shall be the sole responsibility of the entrant.  Limit one (1) entry per person per phone number per date and time.  Contestants may be able to text all three different times per day, but only once per word/instance. On June 19, 2017, ninety (90) contestants will be randomly drawn as qualifiers as text finalist.

  1. Winner Selection. On or about 5:00 p.m. CT on June 29, 2017, all qualifiers must present in-person and register, presenting a current/valid government issued photo ID at Fort Thunder Harley Davidson, 500 SW 11th Street, Moore, OK 73160.  Qualifiers must be checked in no later than 5:30 p.m.  Failure to check in and/or present a valid/current government issued photo ID will lead to disqualification and at that time the Qualifier will no longer be eligible to win the Grand Prize. No proxies will be allowed.  You must remain present throughout the duration of the Grand Prize Event in order to be eligible to win the Grand Prize. Upon check-in a Qualifier will be assigned a number between 1 and 100.  Stations will be participating in a reverse drawing, meaning the last remaining name/number selected and the last remaining number wins the Grand Prize, subject to verification. ENTRANT MUST BE AND REMAIN PRESENT TO WIN.  The winning entrant will be contacted using the email address and/or telephone number provided with the entry and may be awarded the prize (subject to verification of eligibility and compliance with the terms of these rules). Station’s decisions as to the administration and operation of the Contest and the selection of the potential winner are final and binding in all matters related to the Contest. Failure to respond to the initial verification contact within three (3) days of notification will result in disqualification.
  2. Verification of Potential Winner. POTENTIAL CONTEST WINNER IS SUBJECT TO VERIFICATION BY STATION WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. The potential winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The potential winner will be notified by email and/or telephone call after the date of random drawing and/or winner determination. The potential winner will be required to sign and return to Station, within three (3) days of the date notice is sent, an affidavit of eligibility and a liability/publicity release (except where prohibited) in order to claim his/her prize, if applicable.  A winner who returns the affidavit of eligibility and liability/publicity release will be deemed to have accepted the Contest Prize and thereafter will not be permitted to rescind their acceptance of the prize and/or return the prize. If a potential winner cannot be contacted, fails to sign and return the affidavit of eligibility and/or the liability/publicity release within the required time period (if applicable), or if the prize or prize notification is returned as undeliverable, potential winner forfeits prize. In the event that the potential winner of a prize is disqualified for any reason, Station may award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries.    
  3. Grand Prize. One (1) Grand Prize will be awarded in this Contest.  The Grand Prize is a 2017 Harley Davidson Roadster XL1200CX.

ARV $11,299.00 Winner is responsible for all taxes associated with prize receipt and/or use.  Odds of winning the Grand Prize depend on a number of factors including the number of eligible entries received during the Contest Period and listeners participating at any given time.  Station reserves the right to substitute any listed prize for one of equal or greater value for any reason. The Grand Prize Winner must be willing and able to take possession of the Grand Prize on the date of June 29, 2017, but in no event later than close of business on Monday, July 3, 2017.  Failure to take possession by July 3, 2017 will lead to forfeiture of the Grand Prize      

  1. Entry Conditions and Release. By entering, each participant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Station, which are binding and final in all matters relating to this Contest; (b) release and hold harmless Station, Cumulus Media Inc., and its subsidiaries, related and affiliated companies, participating sponsors, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest, and each of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Contest, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorneys’ fees) arising out of or relating to an entrant’s participation in the Contest and/or entrant’s acceptance, use, non-use or misuse of the prize.
  2. Except where prohibited, participation in the Contest constitutes winner’s consent to Station’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration, unless otherwise prohibited by law.
  3. All State, Local, Federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner.  All those who win a prize or prizes valued $600 or more in any given year will be issued an IRS Form 1099 to report their winnings.
  4. General Conditions. Station reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Station’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Station in its sole discretion. Station reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Station reserves the right to seek damages from any such person to the fullest extent permitted by law. Station’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
  5. Limitations of Liability. The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use, non-use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Contest, provided that if it is not possible to award another entry due to discontinuance or completion of the Contest, or any part of it, for any reason, Station, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In event that production, technical, programming or any other reason causes more than stated number of prizes as set forth in these Official Rules to be available or claimed, Station reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
  6. Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, other than those concerning the administration of the Contest or the determination of the winner, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate state court located in the Station’s listening area; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the state in which the Station is located, without giving effect to any choice of law or conflict of law rules (whether of the state in which the Station is located or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state in which the Station is located.
  7. Entrant’s Personal Information. Information collected from entrants is subject to Station’s Privacy Policy, which is available on the Station’s website under the “Privacy Policy” link. All entry blanks, forms, devices, and materials gathered during the course of entry, as well as all information contained on or within, shall become the sole property of Station to be used, disposed of or destroyed in its sole discretion. Station is not responsible for any incorrect or inaccurate information entered by website users, and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to Station’s website.
  8. Contest Results. A winners list may be obtained within thirty (30) days after the Contest Period expires by sending a self-addressed stamped envelope to the Contest Sponsor identified below.
